on the implementation of sales through the Electronic Infrastructure
This offer agreement on the implementation of sales through the Electronic Infrastructure (hereinafter referred to as the "Terms") sets forth the essential conditions for the provision of services for the production and sale of catering products and other goods.
The terms of the public offer are an offer to conclude a Retail Sale and Purchase Agreement for goods and the provision of catering services and their delivery by the Seller to the Buyer. The Buyer, having read these Terms, accepts them by performing the actions specified in these Terms.
The Website, the Mobile Application and the Telegram bot provide information on the main consumer properties of the Goods, the address of the Seller, the place of manufacture of the goods, the price, terms of purchase, delivery, payment procedure, expiration date, as well as the validity period of this Offer.
1. Definitions and terms
1.1. Offer – a public offer of the Seller addressed to any individual or legal entity to enter into a sale and purchase agreement with them on the existing terms and conditions contained in this Agreement.
1.2. Buyer – any individual or legal entity with civil legal capacity who orders the Goods through the website, mobile application, Telegram bot or call center and uses catering services exclusively for personal needs.
1.3. Seller – BIBIGON BOX group of companies
1.4. Goods – products from the range presented on the Seller’s website.
1.5. Order – individual items from the range selected and ordered by the Buyer through the Electronic Infrastructure.
1.6. Website – the Seller’s website https://www.bibigonbox.uz/
1.7. Mobile application – the BIBIGON BOX application, posted on Google Play and the App Store.
1.8. Telegram bot – @bibigonbox_bot program in Telegram messenger.
1.9. Call center – division of the Seller, processing orders via phone number +998 71 113 03 06
1.10. Electronic infrastructure – Website, Mobile application, Telegram bot and Call center taken together.
1.11. Delivery service – employees or representatives of the Seller, delivering the Goods to the Buyer.
2. General provisions
2.1. These Terms are a public offer within the meaning of Article 367 and paragraph 2 of Article 369 of the Civil Code of the Republic of Uzbekistan.
2.2. Relations between the Buyer and the Seller are regulated by the Civil Code of the Republic of Uzbekistan, the Law "On Protection of Consumer Rights", and other legal acts.
2.3. Acceptance of the Terms is carried out by:
• clicking the "Place an order" button;
• self-registration on the Website;
• confirmation of the order via the Call Center.
2.4. Ownership of the Goods passes to the Buyer after full payment and actual transfer of the Goods.
2.5. The Seller undertakes to ensure the confidentiality of the Buyer's personal data.
3. Registration and fulfillment of the Order
3.1. The Order can be placed via the Website, Mobile Application, Telegram bot or Call Center.
3.2. The Buyer provides the information necessary to place the Order:
• name,
• contact phone number,
• delivery address,
• comments (if necessary).
3.3. The Buyer is responsible for the accuracy of the information provided.
3.4. The Seller reserves the right to clarify the details of the Order.
3.5. Delivery is carried out only within the city of Tashkent within a radius of 1 km from the operating branch according to the schedule:
• Monday through Sunday from 09:00 to 22:00;
4. Delivery of Goods
4.1. The Seller will make every effort to meet the delivery deadlines, but is not responsible for delays caused by force majeure.
4.2. If the Buyer is not at the specified address, the Delivery Service employee waits for 10 minutes, after which he leaves.
4.3. The Buyer is obliged to check the completeness of the Order upon receipt. If there are no claims, the Buyer signs the check and pays for the order (if no prepayment was made).
4.4. The Seller reimburses the cost of prepaid but not delivered Goods after confirmation of this fact.
5. Payment for Goods
5.1. The price of the Goods is indicated in the Electronic Infrastructure and can be changed by the Seller before the Order is placed.
5.2. Payment methods:
• cash to the courier upon receipt;
• bank card via terminal;
• online payment via payment systems.
6. Return of goods
6.1. Food products of proper quality are not subject to return.
6.2. Return of goods of improper quality is possible upon presentation of a claim at the time of delivery.
6.3. Refunds are made in the same way as the payment was made.
7. Privacy Policy
7.1. The Seller processes the Buyer's personal data only with his consent.
7.2. The Buyer has the right to request the deletion of his data by contacting the Seller.
8. Other conditions
8.1. All disputes are resolved through negotiations. If agreement is not reached, the dispute is referred to the court in accordance with the legislation of the Republic of Uzbekistan
